Quantum Pharma Australia Pty Ltd ("QPA") - Privacy Policy

QPA respects the privacy of all individuals with whom it has dealings and takes its privacy obligations seriously and is committed to protecting all personal information and implementing responsible privacy practices. We are guided by the Privacy Act 1988 (Act) and apply the Australian Privacy Principles (APP) as our standard for the collection and use of personal information. More information about the Act and the APP is available at the Office of the Australian Information Commissioner - website at www.oaic.gov.au This Privacy Policy explains how we protect the privacy of personal information in accordance with the APP and Act. This Privacy Policy governs all personal and sensitive information collected by and provided to QPA and must be followed by all persons who deal with personal information on our behalf. You have the right to be informed about how we deal with your personal information so if you are unclear on any matters or would like more information please contact us through the details provided below. In summary, 'personal information' is information or an opinion relating to an individual which can be used to identify that individual. Sensitive information is: information or an opinion about a person's racial or ethnic origini, political opinions, religion, philosophical beliefs, trade union or other professional or trade association membership, sexual orientation or practices, or criminal record; health information about an individual; genetic information about an individual; biometric information for verification or identification purposes; or biometric templates. This Privacy Policy tells you about the ways in which we collect personal information and how we use and disclose that information.

Consent to terms of Privacy Policy

If you:

  • Submit an online enquiry
  • Undergo a Nuclear Medicine (diagnostic or theranostic) or PET procedure at a Nuclear Medicine facility we supply goods and/or services to - you consent to the practices described in, and agree to the terms of this Privacy Policy
  • Make general inquiries in person or via electronic communication such as e-mail

Information we collect about you

QPA collects information primarily in order to conduct our business, to provide our services and to meet our legal obligations. We will only collect information about you with your consent and if the information is reasonably necessary for one or more of our functions or activities or if otherwise allowed under the Privacy Act. Our objective is to only collect information that is relevant and necessary to providing appropriate goods and/or services relevant to you.

Type(s) of Information:

The type of information we may collect includes (but is not limited to):

  • Individual and company names, contact details, email addresses, licenses, agreements, quality control methods, complaints and other information about your inquiry
  • Patient Health information including identifying information (where relevant) - for example, patient name, address, patient number or date of birth, medication record and other healthcare information that a treating physician or other healthcare practitioner may provide us

In general you can assume that we will collect and hold the relevant information about you for the period defined in relevant legislation or professional body guidelines.

Collection

QPA generally collects your personal information from a variety of sources. For example, we may collect personal information from you in the following circumstances: when you deal with us over the phone, send us correspondence (whether by letter or email), use our online ordering portal or when you have contact with us in person. There may be times when we need to source information about you from a third party. For example, we may collect personal information from a company for whom you work, other organisations with whom you have any dealings, a credit reporting agency, an information service provider or from a publicly maintained record. We also may collect information from treating physicians or other healthcare practitioners. In addition to the personal information specified above, you consent to the collection of the following sensitive information:

  • details of pharmaceuticals ordered for you by you treating physician or other healthcare practitioner
  • details about medical and general health

Much of the information we ask for is because of legal/legislative/professional body requirements for it to be collected. For example, for certain services it may be required for us to collect personal details contained in the order - such as for radiopharmaceutical orders (which is where we get most of our information about you).


We may use and disclose your personal information for the primary purpose for which it is collected, for allowable secondary purposes and in other circumstances authorised by the Privacy Act.

In general, we use and disclose you personal information for the following purposes:

  • to conduct our business operations
  • to provide services
  • to communicate with you
  • to purchase from you
  • to comply with legal obligations; and
  • to help us manage and enhance our services

You are not obliged to give us your personal information. If you would like to access our services on an anonymous basis we will take reasonable steps to comply with your request, however please be aware that your request to be anonymous may affect our ability to provide you with the requested goods/services and may be impracticable or not compliant with legal/regulatory obligations in the circumstances.

Use of and Access to Personal Information:

QPA will only use and disclose your personal information for the purposes set out above. We may disclose your personal information to other companies, or individuals who assist us or who are involved in providing direct medical care if you are a patient (i.e. Physicians or other healthcare practitioners). Personal information may be collected from orders (online, by email and/or phone) and entered into our database to record goods and/or services provided to you through your treating physician.

We may from time to time be required to disclose your personal information to the following third parties

  • Certain statutory bodies as required under relevant legislation
  • To assist police in an official investigation
  • Where safety may be of a concern

Your personal information will not be disclosed to overseas recipients.

Security

QPA takes all reasonable steps to protect personal information held from misuse and loss and from unauthorised access, modifications or disclosure, for example by use of physical security and restricted access to electronic records. We also have the following security measures in place to protect your information.

  • Our locations of operation are securely locked after hours
  • All computers have password protection
  • Employees all sign confidentiality agreements on commencement of employment with QPA

Where we no longer require your personal information for a permitted purpose, we will take reasonable steps to destroy it. If we receive unsolicited personal information that we would not have been able to otherwise lawfully collect under the APP we will take reasonable steps to destroy that information.

Personal information quality

QPA aims to ensure that your personal information is accurate, complete and up to date. If you believe that the information we hold about you is inaccurate or incomplete, contact us and we will use all reasonable efforts to correct the information.

Accessing your personal information

You may request access to or correction of the personal information that we hold about you. We will give you access to, or correct your personal information unless there is a lawful reason for refusing for access or correction. You may review and update or correct your information by contacting us on the details provided below.

Complaints

If you have a complaint about our collection, use or disclosure of your personal or sensitive information, or you wish to make a complaint about a breach of APP, contact us on the details provided below detailing the nature of your complaint. We will review the details of your complaint and use our best endeavours to deal with your complaint sensitively and in a timely manner.
